Privacy Policy

Fobalanz (“we”, “our”, or “us”) is operated by nova33 LLC, a limited liability company registered in New Mexico, USA (500 4th St NW, Ste 102, Albuquerque, NM 87102). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use the Fobalanz mobile application (“App”). By using the App, you agree to the practices described in this policy.

2.1 Information you provide directly

• Full name and email address when creating an account
• Password (stored encrypted, never in plain text)
• Profile data: age, sex, weight, height, activity level, dietary goals, and health conditions provided during onboarding
• Food photos you take or upload for nutritional analysis
• Meal logs and food diary entries

2.2 Information collected automatically

• App usage data and feature interactions (to improve the service)
• Device type and operating system version (for debugging and compatibility)
• Crash reports and error logs

2.3 Information from third-party sign-in

If you use Sign in with Apple or Sign in with Google, we receive your name and email address from those providers, subject to their privacy policies.

• To create and manage your account
• To provide personalized nutrition tracking and AI-powered food analysis
• To calculate your nutrition scores and generate personalized insights
• To send push notifications for meal reminders and nutrition tips (only if you explicitly opt in)
• To process subscription payments and manage your plan
• To respond to your support requests
• To improve the App through analysis of aggregated, anonymized usage data
• To comply with legal obligations

We do not use your personal data for advertising purposes and do not sell your data to third parties.

Photos you submit for food analysis are sent to OpenAI’s API solely for the purpose of identifying nutritional content. These photos are not stored by OpenAI beyond the processing of each individual request, in accordance with OpenAI’s API data usage policy. We do not store your food photos on our servers after analysis is complete.

We share your data only with the following trusted service providers, strictly to operate the App:

• Supabase — Account authentication and data storage (supabase.com/privacy)
• OpenAI — AI food image analysis (openai.com/privacy)
• Apple (StoreKit) — Subscription management on iOS (apple.com/privacy)
• Expo / EAS — App delivery and push notifications (expo.dev/privacy)

We do not share your data with advertisers, data brokers, or any other third parties not listed above.

Your personal data is stored on Supabase’s secure cloud infrastructure. All data is transmitted over encrypted HTTPS connections. Access to your data is protected by authentication and restricted to authorized personnel only. While we implement industry-standard security measures, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

We retain your personal data for as long as your account is active. If you delete your account, we will permanently delete all your personal data within 30 days, except where retention is required by law.

You have the right to delete your account and all associated data at any time. To do so:

1. Open the App and go to Profile → Settings
2. Tap Delete Account
3. Confirm the deletion

Alternatively, you can request account deletion by emailing hello@fobalanz.com with the subject “Account Deletion Request”. We will process your request within 30 days and confirm via email when complete.

Upon deletion, all your personal data, meal logs, nutrition history, and profile information will be permanently removed from our systems.

9.1 GDPR (European Union users)

If you are located in the EU, you have the right to:

• Access the personal data we hold about you
• Correct inaccurate or incomplete data
• Request deletion of your data (“right to be forgotten”)
• Restrict or object to processing of your data
• Request portability of your data in a machine-readable format
• Withdraw consent at any time where processing is based on consent

9.2 CCPA / CPRA (California residents)

If you are a California resident, you have the right to:

• Know what personal information we collect, use, and disclose
• Request deletion of your personal information
• Opt out of the sale of your personal information (note: we do not sell personal information)
• Non-discrimination for exercising your privacy rights

9.3 All users

Regardless of location, you can at any time:

• Update your profile information within the App
• Disable push notifications in your device settings
• Delete your account as described in Section 8

Fobalanz is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at hello@fobalanz.com and we will promptly delete it.

We may send push notifications for meal reminders and nutrition tips. You can opt in or out at any time through your device’s notification settings or within the App under Profile → Notifications.

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by sending a push notification or displaying a prominent notice in the App before the changes take effect. The updated policy will always be accessible at the Privacy Policy URL provided in the App. We encourage you to review this policy periodically.
